Terms of Service

These terms govern your use of the Morphemeris API and website. We have written them in plain language because we believe you should understand what you are agreeing to. The short italic summaries at the start of each section are provided for convenience only and are not legally binding.
1. Acceptance of Terms
By using Morphemeris, you agree to these terms.
By creating an account or making requests to the Morphemeris API, you agree to be bound by these Terms of Service. If you do not agree, do not use the service.
You must be at least 18 years old, or the age of majority in your jurisdiction, to use Morphemeris. If you are signing up on behalf of an organization, you represent that you have authority to bind that organization to these terms.
2. Definitions
What we mean when we use certain words.
- "Service" means the Morphemeris API and the Morphemeris website at morphemeris.com.
- "API" means the REST endpoints available at api.morphemeris.com.
- "User" or "You" means anyone who creates an account or uses the Service.
- "Account" means a registered Morphemeris account.
- "API Key" means the bearer token used to authenticate requests to the API.
- "Credits" means prepaid request units that are deducted when you make API calls.
- "Output Data" means the astronomical and astrological calculation results returned by API responses.
3. Accounts & API Keys
Keep your keys safe — you are responsible for what happens with them.
You must provide accurate information when creating your account. Each person or entity may hold one account. You are solely responsible for safeguarding your API keys — treat them like passwords. You are liable for all activity that occurs under your API keys, whether or not you authorized it.
We may revoke API keys that are used in violation of these terms.
4. Service Description
We provide astronomical calculations — not advice, predictions, or recommendations.
The Morphemeris API returns astronomical and astrological calculation data: planetary positions, house cusps, fixed stars, and related mathematical results. All computations are derived from the Swiss Ephemeris.
The API does not provide advice, predictions, recommendations, or interpretations of any kind. Output Data consists of mathematical and astronomical facts.
5. Billing & Credits
Free tier is free. Paid credits are prepaid, never expire, and are non-refundable.
- Free tier: 1,000 requests per calendar month. Resets on the 1st. No rollover. No credit card required.
- Prepaid credits: Purchased in advance via Stripe, deducted at one credit per request. Credits never expire.
- Non-refundable: Purchased credits are non-refundable except where required by applicable law.
- Payment processing: All payments are processed by Stripe. By purchasing credits, you also agree to Stripe's Services Agreement.
- Pricing changes:We may change pricing with 30 days' advance notice. Credits you have already purchased are honored at the rate you paid.
- No surprise charges: When your credits run out, requests return a 402 error. No debt is incurred and no automatic charges are made (unless you have enabled auto-top-up).
- Disputes: If a payment is disputed or refunded, the equivalent credits are removed from your account.
6. Acceptable Use
Use the API to build things. Don't abuse it or try to break it.
You may not:
- Abuse, overload, or interfere with the API or its infrastructure.
- Circumvent rate limits, authentication, or other technical restrictions.
- Resell raw API access. (Building applications on top of the API is encouraged.)
- Reverse-engineer the API, the underlying WASM binary, or attempt to extract ephemeris data files.
- Create multiple accounts to exploit the free tier.
- Use the Service for any unlawful purpose.
7. Intellectual Property
You own your apps; we own the API; astronomical facts are free for everyone.
Morphemeris owns all rights to the API, its documentation, the underlying computation engine, and the WASM binary. We grant you a limited, non-exclusive, revocable, non-transferable license to access the API for the purpose of building your own applications.
You retain full ownership of the applications you build using the API.
Output Data — planetary positions, house cusps, fixed star coordinates, and similar results — consists of astronomical and mathematical facts. These are not copyrightable. You may freely use, store, redistribute, and build upon API output in your applications with no attribution required.
8. Warranty Disclaimer
The service is provided as-is. We don't guarantee it will be perfect or always available.
The Service is provided "AS IS" and "AS AVAILABLE." Morphemeris expressly disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Astronomical calculations are based on the Swiss Ephemeris and are intended for general computational use. We make no warranty regarding fitness for navigation, safety-critical systems, or any specific application. We do not guarantee uninterrupted or error-free operation.
9. Limitation of Liability
Our maximum liability is capped at what you've paid us (or $100 for free-tier users).
To the maximum extent permitted by law, Morphemeris's total aggregate liability for any claims arising out of or related to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) $100 USD.
We are not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost data, or business interruption.
This limitation does not apply to liability arising from gross negligence, willful misconduct, or fraud. Some jurisdictions do not permit certain limitations — in those cases, our liability is limited to the minimum extent permitted by law.
10. Service Availability & Changes
We may change the service over time, but we'll give you notice.
We may modify, suspend, or discontinue any part of the Service with reasonable notice. Scheduled maintenance will be communicated in advance where feasible. Breaking API changes follow semantic versioning, and deprecation timelines are published in our documentation.
11. Third-Party Services
We rely on services like Cloudflare and Stripe — we're not responsible for their outages.
The Service relies on third-party infrastructure including Cloudflare, Vercel, Clerk, Stripe, and Convex. We are not responsible for outages, errors, or data handling by these providers. We encourage you to review their respective terms and privacy policies.
12. Termination
Either of us can end this at any time. Violations may result in immediate termination.
Either party may terminate at any time. We may suspend or terminate your account immediately if you violate these terms. On termination, your API access is revoked. Unused credits are forfeited unless applicable law requires otherwise.
Sections that by their nature should survive termination — including Intellectual Property, Limitation of Liability, Indemnification, and Governing Law — survive.
13. Indemnification
You're responsible for what you build with the API.
You agree to indemnify and hold Morphemeris harmless from any claims arising from (a) your application or your end-users' use of it, (b) your violation of these terms, or (c) your violation of any applicable law.
14. Governing Law & Disputes
Disputes are resolved by arbitration, with a small-claims court option.
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Disputes will be resolved by binding arbitration under the rules of the American Arbitration Association, with a carve-out for claims that qualify for small claims court. You agree to waive your right to participate in class actions.
15. Modifications to These Terms
We'll give you 30 days' notice before changes take effect.
We may update these terms from time to time. When we do, we will post the revised terms on this page, update the "Last updated" date, and notify you by email or by a prominent notice on the website at least 30 days before the changes take effect. Continued use of the Service after the notice period constitutes acceptance of the revised terms.
